This End-User License Agreement ("EULA") is between you and Kalos Health only, and not with Apple. Kalos Health, not Apple, is solely responsible for the Kalos Health application and its content. The terms of this EULA may not conflict with the Apple Media Services Terms and Conditions.
The license granted to you for the Kalos Health application is limited to a non-transferable license to use the application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that such application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
Kalos Health is solely responsible for providing any maintenance and support services with respect to the application. You and Kalos Health acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the application.
In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Kalos Health's sole responsibility.
Kalos Health, not Apple, is responsible for addressing any claims of the end-user or any third party relating to the application or your possession and/or use of that application, including, but not limited to: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. This EULA does not limit Kalos Health's liability to you beyond what is permitted by applicable law.
In the event of any third-party claim that the application or your possession and use of the application infringes that third party's intellectual property rights, Kalos Health, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with applicable third-party terms of agreement when using the application (e.g., you must not be in violation of your wireless data service agreement when using the application).
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
Kalos Health Premium is an auto-renewable subscription. Payment is charged to your Apple ID account upon confirmation of purchase. Your subscription begins with a 7-day free trial for eligible new subscribers; you will not be charged during the trial period. After the free trial ends, the subscription automatically renews on a monthly basis at the price shown at the time of purchase, unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription at any time in your App Store account settings. Cancelling stops future renewals; the current paid period is not refunded except as required by law. Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
If you subscribe in the Android app, payment is charged to your Google Play account instead, under the same plan, trial and renewal terms shown at purchase and the Google Play Terms of Service. You can manage or cancel at any time in the Play Store (your profile → Payments & subscriptions → Subscriptions). The Apple-specific terms in this agreement apply only to the iPhone app.

Kalos Health is not a substitute for professional medical advice, diagnosis, or treatment. You use the workout plans, nutrition guidance, and all other content at your own risk, and you assume full responsibility for any risks, injuries, or damages that may result.
Kalos Health includes Coach K, an AI-assisted coach. Coach K's responses and recommendations are produced automatically and may be inaccurate, incomplete, or unsuitable for your individual circumstances. Coach K's features do not constitute medical, nutritional, or professional advice, and should not be relied upon as such. Always apply your own judgment and consult a qualified professional where appropriate.
Physical exercise and dietary changes carry inherent risks. By using Kalos Health, you acknowledge these risks and agree that Kalos Health and its owners, employees, and affiliates are not liable for any injury, loss, or damage arising from your use of the application or reliance on its content, to the maximum extent permitted by applicable law. Nothing in this agreement excludes or limits liability that cannot be excluded or limited under applicable law, including under the Australian Consumer Law.
